Subject: Appearance of criminal conduct by a public officer (Scroll down for report)

Dear Sirs and Madame;

I offer this observation with the purpose of furthering any good that can be derived from the correction of official conduct destructive of the People's trust and tolerance of government.

We have an intolerable population in government today. Our founders would have thrown the lot of you out by the scruffs of your necks many decades ago, but our People have forgotten the taste of  liberty and lost the corollary disgust for petty tyrants and public miscreants. My personal hope is that this disgusting condition is merely a temporary neglect by our People and that we will soon return dignity and service to those who seek public office and employment.

Until then, here is one of countless observations of petty, endemic misconduct by a member of our "Special Culture".

Observation by Henry Nicolle:

Date of observation: 30 June, 2006
Time of observation: Approximately 1525h (3:25 P.M. Pacific)
California Highway Patrol vehicle License: 1189481 (Marked CHP Squad Car)
CHP officer: Male, Caucasian, about 30-35 years old, medium build, medium height
Private automobile vehicle License: 5CGN030 (unmarked White Van)

General Location of observation: Valentine Road at Sperry Avenue (See map)

Private automobile: West of Sperry, going Eastbound on Valentine
Initial location of CHP vehicle: Out of sight, on Sperry, South of Valentine, apparently Northbound on Sperry.

Initiating event for observation:
The observer was trailing the private automobile/van by about four seconds, Eastbound on Valentine.

The observer was aware that the traffic signal at the intersection of Valentine and Sperry was "GREEN" for both the private automobile/van and for the observer.

No other automobiles or vehicles were noted at the time of the observation on either Valentine or Sperry.

The observer noticed the Northbound approach of the CHP vehicle from the South, approaching the intersection.  By this time the private automobile/van had passed through the intersection on a "GREEN" traffic control signal.

The observer noted that the CHP vehicle slowed, but did not stop at the intersection and turned Eastbound on Valentine, the proximity requiring the observer to reduce speed to safely accommodate the CHP entry.

Although no exigency was apparent, and since the observer was alert to the hazard of the CHP entry, no obvious public endangerment was observed.

However, the conduct of the CHP vehicle was sufficiently extraordinary so as to provoke in the observer's mind the question, "What's got this guy on the run? Must be something going on close by. (Stay alert for unexpected events.)"

The CHP driver accelerated to approximately 40 MPH and proceeded Eastbound on Valentine for several seconds, then activated the vehicle's Lightbar. The observer had not seen any cause for this activation.

The observer briefly lost direct sight of the van and the CHP in the curving course of the roadway.

After a few (3 to 5) seconds, the observer noted that the CHP had fallen in behind the van and both stopped by the traffic control signal Eastbound at the intersection of Valentine and Victoria Blvd. The observer fell in line behind the two drivers.

The observer followed the two drivers across the intersection and in order to not interfere with the event, waited in the Shell Station lot until the arrest had been completed.

The observer noted the CHP license at this time.

The arrestee was allowed to depart and the observer followed the arrestee into an adjacent parking lot, where the observer flagged down the arrestee.

The conversation between the arrestee and the observer is here briefly recalled:

Observer: "Why did the CHP stop you?"
Arrestee: "The CHP said I ran the red light. I told him that I did not, but if I did, it must have just turned yellow."
Observer: "Where were you coming from?"
Arrestee" "I was coming from Market."
Observer note: "Market" changes name to Valentine" West of Sperry.
End of observation.
Observer's conclusions:
It appears that the CHP did NOT observe an actual red-light violation. There may have been other factors affecting the eyesight or judgment of the officer, but reality did not appear to be one of them.

The observer is prepared to testify on behalf of the arrestee, if the arrestee so desires.

The CHP officer appears to have interrupted a common traveler without a clear and valid justification. If that observation is correct, the CHP conduct is criminal, unethical and a violation of both the officer's oath and duty. The event is no less serious if it was the case that the CHP was inattentive or in careless error of observation. Lawless arrest and interference of  liberty and property cannot be tolerated in the conduct of guardians of the People's Trust.

Such conduct appears to be more commonly observed than should be expected in a free society and whether intentional, in error or by carelessness it is destructive of the common peace and of the respect and trust expected between Citizens and public servants.

If we are to retain a peaceful society, those people who make and enforce our laws must voluntarily and stringently hold their own conduct to the highest standard for obedience to our laws and preservation of the public trust. When they do not, as it appears in this instance, they are not public employees, but merely criminals acting in the color of law - petty tyrants, highwaymen and armed thugs, benefiting only themselves at the expense of our society. Neither they, nor their conduct can be protected by our institutions nor condoned in our courts without public violence becoming our substitute for the absent processes for justice by law.

For those people who are careless of our laws and yet elect to serve in public capacity, I say, "You're Fired!" I do not accept your attempts at governance nor do I accept your appearance of authority. If my position requires that we empty our public employment roles by whatever means are necessary, and then replace them with fewer and more obedient souls, then so be it.

The People, not the LEOs are the true government and the enforcers of lawful conduct. CHP personnel and their management must never forget this simple fact. Our Representatives and Courts must never allow it to be forgotten. When our servants abandon their Duties and betray their Masters, they become our Enemies. The choice is always left to those who serve to decide for themselves, if they will faithfully serve or command by treachery. The latter choice is fatal, often to all the parties. Let us not allow betrayal and treachery by people in government service to continue.
